Terms of website use

These terms and conditions of use tell you the terms on which you may make use of the website www.croptrust.org, its subdomains, associated websites and extranets (collectively the “Site”).

Use of our Site includes downloading, copying, accessing, browsing or any other use of any information from the Site.

By accessing any part of this Site you shall be deemed to be a “Site User” and to have accepted these Terms in full whether or not you become a donor. If you do not agree to these Terms then you are not authorised to use or continue using this Site and should cease doing so.

We may amend these Terms at any time by changing them on the Site and the amendments will be effective as soon as they are displayed.

Crop Trust projects

This Site is distributed internationally and may contain references to projects that are not in your country. All questions about Crop Trust projects should be directed to info@croptrust.org.

Donations

Certain Site features may allow Site Users to make donations in support of the Crop Trust and its projects and activities using a number of different means including credit cards, debit cards and other payment methods (each a “Payment Method”). Donations will be in the form of direct contributions to the Crop Trust. The Site User acknowledges and agrees that any donation is explicitly provided as an unrestricted gift and the Crop Trust makes no representation, warranty, covenant or guarantee that a donation will be used for any particular geographic region, project or community.

By providing information related to a Payment Method, the Site User represents, acknowledges and agrees that the Site User: (i) is permitted to use that Payment Method; and (ii) shall be the sole person responsible for any fee charged by the User’s financial institution or other payment method provider. When the Site User makes a donation, the Site User authorises the Crop Trust (and its designated payment processor) to collect, process and store information related to the relevant Payment Method and other related transaction information to conduct the transaction and help better manage donors and donations.

The Crop Trust takes every reasonable care to ensure that all donations and related transactions are conducted via a secure link. However, the security of information and payments transmitted via the internet cannot be guaranteed. The Site User acknowledges and agrees that: (i) donations to the Crop Trust are at the Site User’s own discretion and risk; and (ii) the Crop Trust has no liability whatsoever for (a) any loss the Site User may suffer if a third party obtains unauthorised access to any information provided by the User and (b) any act or omission by the Site User’s financial institution, credit, debit card or other payment method provider, telecommunications services providers or any third party in connection with the donations to the Crop Trust and transactions related thereto.

Payments

You represent and warrant that if you are donating to the Crop Trust (i) any credit information you supply is true and complete; (ii) charges incurred by you will be honored by your credit card company; and (iii) you will pay the charges incurred by you at the posted prices, including any applicable taxes.

Acceptable use policy

You may only use the Site for lawful purposes. In accessing any part of this Site you agree:

  1. Not to use this Site in such a way that disrupts, interferes with or restricts the use of this Site by others
  2. Not to upload, display or transmit any materials through this Site which are false, offensive, defamatory, threatening, obscene, unlawful or which infringe the rights of any other person anywhere in the world;
  3. Not to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam);
  4. Not to reverse engineer, decompile, copy or adapt any software or other code or scripts forming part of this Site or attempt to transmit to or via this website any information that contains a virus, worm, Trojan horse, time-bomb, keystroke logger, spyware, adware or other harmful or disruptive component designed to adversely affect the operation of any computer software or hardware; and
  5. Not to change, modify, delete, interfere with or misuse data contained on this Site and entered by or relating to any third-party user of this Site.

Accuracy of information and disclaimer

The content on this Site is provided for general information only. We do our best at all times to ensure that all information on the Site is accurate but we make no representations, warranties or guarantees whether express or implied that the content on the Site is accurate, complete or up-to-date.

The presentation of information on the Site does not imply the expression of any opinion whatsoever on the part of the Crop Trust concerning the legal or development status of any country, territory, city or area or of its authorities or concerning the delimitation of its frontiers or boundaries. The findings, interpretations and conclusions expressed in material made available on the Site are those of the authors of the relevant content and do not necessarily reflect the views or policies of the Crop Trust.

Limitation of our liability

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms that may apply to the Site or any content on it, whether express or implied. In no event shall we be liable to you for any direct, indirect or consequential loss, loss of profit, revenue, goodwill arising from your use of our Site, information on the Site or temporary suspension of the Site by us for any reason.

We shall not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any content on it, or on any website linked to it.

Our intellectual property rights

The Crop Trust owns or is licensed to use all the intellectual property rights in and to this Site and the material published on it and all technical infrastructure relating to it. These works are protected by intellectual property laws and treaties around the world.

The content of the Site is protected by copyright and related intellectual property rights. To ensure wide dissemination of its information, the Crop Trust is committed to making its content freely available and encourages the use, reproduction and dissemination of the text, multimedia and data products presented. Except where otherwise indicated, content may be copied, printed and downloaded for private study, research and teaching purposes, or for use in non-commercial products or services, provided that appropriate acknowledgement of the Crop Trust as the source and copyright holder is given and that the Crop Trust’s endorsement of Site Users’ views, products or services, is not stated or implied in any way and provided that no trade mark, copyright or other proprietary notices contained in or appearing on such material is removed in whole or in part.

The Crop Trust’s name, emblem and abbreviation (the “Crop Trust Marks”) are the exclusive property of the Crop Trust and are protected under international law. Unauthorised use of the Crop Trust Marks is prohibited. The Crop Trust Marks (or any one of them) may not be reproduced or used in any manner without the Crop Trust’s prior written permission.

The Crop Trust encourages unrestricted use of press releases provided on the Crop Trust website and no formal permission is required to reproduce these materials.

All requests for translation and adaptation rights, and for resale and other commercial use rights should be addressed to contact us.

Material contained on the Site may not otherwise be copied, reproduced, modified, published, distributed, transmitted, transferred or sold, used to create derivative works or in any way exploited in whole or in part without our prior written consent. You must not reproduce or exploit the material for commercial gain. All other rights are reserved and Users must seek our permission before making any other use of material contained in this Site.

Photographs

Where the Crop Trust is the exclusive copyright holder, conditions for the reuse of photographs displayed on the Site are the same as those for other content, with the exception that photographs must not be modified without the Crop Trust’s prior written consent. Where the copyright ownership is shared between the Crop Trust and the photographer (or where ownership cannot be determined from the Site) permission must be requested for any reuse other than downloading for private use, research and teaching purposes.

Written permission must be requested from the Crop Trust for any commercial use, advertising, marketing, storage or third-party distribution of the Crop Trust photographs. The Crop Trust reserves the right to withhold distribution and/or permission to reproduce the Crop Trust photographs should the intended use be considered inappropriate. The Crop Trust photographs must be credited each time they are published. The recommended citation format for photographs is the Crop Trust/[name of photographer]. Please send the URL address in which the photograph(s) appear to contact us.

Use of Crop Trust emblem

The Crop Trust emblem (official logo) is the corporate identifier and official seal of the organisation and it is protected under international treaties and conventions on intellectual property. Its use is highly restricted and is prohibited without prior written permission. Requests for use of the Crop Trust emblem for any reason whatsoever, whether or not in association with other logos, must be addressed to contact us. If permission for use of the Crop Trust emblem is granted, instructions for its placement and display, including related disclaimers, must be strictly adhered to. The use and reproduction of content containing the Crop Trust emblem must not be in association with advertising or with the names of proprietary products and must not imply the Crop Trust’s endorsement of products or services in any way. The Crop Trust reserves the right to request the immediate removal of its emblem from unauthorised websites or products.

Linking

Links from this Site to other sites and resources provided by third parties are provided for your information only and we have no control over and cannot therefore accept responsibility or liability for the content of any linked third party website. We will not be liable for any loss or damage that may arise from your use of them. We do not endorse any linked website.

You may link to our home page from a website you own, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. Our Site must not be framed on any other site, nor may you create a link to any part of our Site other than the home page. We reserve the right to withdraw linking permission without notice. Preservation of immunities

Nothing in these Terms shall imply a waiver, express or implied, by the Crop Trust, the United Nations and the Food and Agriculture Organisation of the United Nations of any privileges and immunities enjoyed by them pursuant to the 1946 Convention on the Privileges and Immunities of the United Nations, the 1947 Convention on the Privileges and Immunities of Specialised Agencies, customary international law, other relevant international or national agreements and under domestic law.

Applicable law

These Terms and any dispute arising therefrom shall be exclusively governed by international principles of international law, to the exclusion of any single national system of law.

Any dispute, controversy or claim arising out of or relating to these Terms or the breach, termination or invalidity of them or to the use of the Site by the User or any content available here shall be settled by Arbitration. The arbitration shall be conducted in accordance with the modalities to be agreed upon by the Crop Trust and the Site User or, in the absence of agreement, with the rules of arbitration of the International Chamber of Commerce. The parties shall accept the arbitral award as final. The language of any such proceedings shall be English.

To the extent that there exists more than one language version of these Terms and there is any inconsistency between the versions, the English version shall always prevail.
